Motherhood: Hc Cites Skanda Purana To Stress Importance Of Mother

Ahmedabad: The Gujarat high court drew upon a verse from the ancient Sanskrit texts of ‘Skanda Purana’ to underscore the intrinsic value placed on motherhood in Indian civilization.
Justice Samir Dave quoted from the ancient text, one of the major 18 Puranas, while permitting the abortion of a 17-year-old rape survivor from Dehgam near Ahmedabad.
The court invoked this text after Justice Samir Dave suspected that the victim was not willing to terminate her pregnancy, but her mother strongly advocated for it. Expressing his suspicion that the applicant mother was thrusting her wish upon the daughter to terminate the pregnancy, the judge cautioned against pressuring the girl, emphasizing that parents should not force such decisions on their children.
However, the applicant’s lawyer insisted on the termination of the pregnancy and submitted that the victim was unwed and delivering the baby would bring shame to the family. He also argued that the education of the girl would be affected, too. When the judge witnessed the mother’s unwavering determination, he quoted a couplet from Chapter 6 of ‘Skanda Purana’ — “Naasti matrusama chhaya, naasti matrusama gati. Naasti matrusamah trana, naasti sama prapaa” — to show “the value that a mother held in our society”. The court also provides Hindi translation of the text in its order, saying: “There is no shade, shelter, or protection like a mother. There is no life-giver like a mother”.
While the issue of termination of pregnancy was under consideration, the high court decided to hear the accused person in this case, who was behind the bars under the Pocso Act. He requested the court not to allow the applicant’s mother’s request to terminate the victim’s pregnancy, and he expressed willingness to marry the victim. However, the court rejected his demand and directed the Gandhinagar district medical authorities to undertake the procedure to terminate the pregnancy with an observation, “If the victim does not want to continue with her pregnancy then this Court cannot compel her to continue her pregnancy.”
